The elements of over-persuasion are present in d's attempt to get p to resign;
1) discussion of the transaction at an unusual time or inappropriate time,
2) consummation of the transaction in an unusual place,
3) insistent demand that the business be finished at once, 4) extreme emphasis on untoward consequences of delay, 5) the use of multiple persuaders by the dominant side, 6) absence of third party advisors by the servient party, and 7) statements that there is no time to consult advisors or attorneys. p has alleged practically all of the traditional elements of over-persuasion in his complaint. p has plead both the subjective and objective elements entering the undue influence equation and has stated sufficient facts to put in issue the question of whether his free will has been overcome. reversed and remanded.
