The fight continued until moments later when Tyson bit Holyfield’s other ear.1 Tyson was disqualified, and numerous fans were unhappy with the outcome. Some fans were so outraged they decided to sue Tyson, the fight promoters, and the telecasters, seeking a refund.2 The fans sued on the basis of, among other theories, a claim to being third-party beneficiaries to various contracts into which the defendants had entered. 1.
