Before you go ahead and answer the questions please make sure that you answer all 6 questions in detailed. Thank you 1. Tony enters into a contract with Joseph to supply his entire output of guava of each season from his orchid at the then current market price. The guava is to be used by Joseph for making jams. However, the contract didn't contain any clause as to when it can be terminated. Tony gave a one year notice period to Joseph prior to termination of the contract. Joseph intentionally didn't do any arrangements for himself to acquire guavas from elsewhere. When Tony expressed his inability to supply Joseph the Guava's after one year, Joseph sued Tony for breach of contract. Whether or not the approach of Joseph is justified?
2. Steve weighs 465 pounds and looks like it. Steve goes to a store and says that he would like to buy a hammock suitable for someone like himself to sleep in. He makes it clear that it is up to the salesman to select a suitable hammock. The salesman selects a hammock that is perfectly suitable for a normally-sized person but that cannot support someone of Steve's weight. Relying on the salesman's recommendation, Steve buys the hammock. After he is injured when the hammock collapses because it cannot bear his weight, Steve sues the store.
Can Steve recover under the implied warranty of merchantability? Assume that the store is a merchant with respect to hammocks
3. Wanda contracted to sell Mike 100 boxes of ball bearings. The contract did not specify a place of delivery. The ball bearings now reside at Wanda's place of business. Wanda refuses to ship the 100 boxes to Mike, and Mike refuses to come to Wanda's place of business to pick them up. Who is right? Why?
4. Ralf breaches a contract with Smith for making 1,000 Sport goggles. Smith decided to resell them to diminish its losses. Luckily, he got a huge market for that and collected a huge profit. The amount was far more than the contracted price with Ralf. However, now Ralf is
demanding the share from profit. Will Ralf succeed?
5. Wilma, who thought she had a terminal disease, signed over the title to her new Cadillac to her cousin, Kenny, and told him that she wanted him to have the car "after I'm gone." Kenny took the keys and began to use the car. A week later, Wilma was told that her diagnosis had been an error, and that she was not terminally ill. Wilma wants her car back. Can she recover
it from Kenny? Why or why not?
6. Doug Dillard owns a house that he presently rents out to a family. Dillard would like to convert the house into commercial space (for a store or offices), because the rent he could charge for the property as commercial space would exceed what he is realistically able to charge for the house as a dwelling. The house is located, however, in an area zoned by the city for residential uses only. This means that Dillard cannot convert the house to commercial space unless the city grants him a zoning variance, something the city has refused to do. Dillard has therefore sued the city on the theory that the zoning ordinance and the refusal to grant a variance amount to a taking of his property and entitle him to just compensation under the Fifth Amendment. Will Dillard win his case? Why or why not?
