Bristol Farmers Market leased certain property to Gale Industries, Inc., and Per rose Industries. The lease provided that they were to be held jointly and sever
ally liable and that they would not be released from responsibility in the event
of an assignment to a third party. Gale and Penrose assigned their rights under
the lease to Bargain City U. S.A., who subleased their rights to Atlantic Thrift
Centers, Inc. Eventually, both Bargain City and Atlantic Thrift Centers experi-
enced financial difficulties, and Bristol Farmers Market sued Gale and Penrose
Industries. Gale defended on the grounds that the sublease from Bargain to At-
lantic released them from the terms of the original lease. Will Gale and Penrose
Industries be liable on the lease even though the property had been assigned to
others since their original contract? Explain. [Gale duistics. Bristol Farm-
ers Market, Inc., 246 A. 2d 391 (Pa. 1968)]
