home inspection agreement
the inspection is intended to provide the client with an objective evaluation (“the report”) of the property’s functional condition. the report is independent of any real estate contract or other agreements. the report does not assign responsibility for repairs to any party.
contingency
the report is neither a recommendation regarding purchase nor an assessment of value. if the home purchase contract is contingent upon “successful completion” of inspection, the client may choose to revoke the current contract and receive a refund of any money paid to the seller. however, the inspection company does not define “successful completion” and will not participate in any negotiations.
scope
the report is intended primarily to uncover major repair items and safety concerns that are apparent by ordinary visual observation. the inspection includes the following components, systems, and equipment: exposed foundations and structures, exteriors, roofing, plumbing, electrical, attic, interiors, bathrooms, kitchen, basement, crawl spaces, and heating and central air-conditioning. the inspector is a generalist and is not a licensed engineer. repair costs, if given, are estimates only and should be determined by a qualified contractor prior to final commitment.
the inspector will not dismantle and/or move systems, floor coverings, or personal property to expose or inspect concealed or inaccessible conditions. basic working order of built-in appliances will be checked. freestanding appliances, security systems, irrigation systems, and other electronics are excluded. specifically excluded from this inspection are air and water quality, mold, animal or insect infestations, and detection or evaluation of toxic matter (including but not limited to radon, asbestos, or lead) in building material. the client is responsible for contracting with consultants certified to inspect for these contaminants.
limits
the inspection company agrees to provide an objective visual inspection of the property and warrants that it has no interest in the property. no other guarantee is expressed or implied by this agreement. the report is not a home warranty nor any assurance that items found acceptable shall remain so for any period of time. the report is not an appraisal nor any estimation of the value of the property. client agrees not to hold inspection company liable for any unintentional oversight.
standard arbitration clause: any controversy or claim arising out of or relating to this contract, or breach thereof, shall be settled by arbitration in accordance with the construction industry arbitration rules of the american arbitration association. judgment upon the award rendered by the abitrator(s) may be entered in any court.
