But contrary to this, the Brown family had to endure the same said segregation in the case of sending their daughter Oliver Brown to a segregated school far from home instead of the nearby school. So, the Brown family along with a dozen other black families took the Education Board to the court, asking for a reason why their children had to travel far to attend school while there's a school nearby too. With this lawsuit resulted the now famous Brown vs. Board of Education of Topeka case where their case was initially rejected. Taking it to the Supreme court, the court then ruled that the issue of 'equal but separate' was unconstitutional for any school of the public. This case addresses whether the plaintiff has been afforded equal protection of the laws relative to those attending public schools.
