Senate approved the appointments but the Secretary of State has to deliever the confirmation documents. Madison refused to deliver the confirmation documents. Marbury therefore not giving him the job he believed he was owed.

Marbury v. Madison is an essential court case setting precedent for the Supreme Court in the US. The Court ruled they were unable to force the Secretary of State to deliver the confirmation documents because they were unable to rule on such a case. They agreed Madison was breaking the law but they were not allowed to hear this particular case and Marbury should not have been able to file it. However, the Marshall Court took the opportunity to explain the Court's position in relation to Congress. The Court stated they have the power for judicial review which allows them to review legislation for constitutionality but they are not allowed to interfere in the work of Congress.
