the name comes from the name of ernesto miranda, who was arrested in phoenix, arizona march 13, 1963 on charges of kidnapping and rape. during the hearing the police have not offered the defendant the right to counsel, and miranda confessed to both crimes. the court found him guilty of both crimes on the basis of his testimony. arizona supreme court approved the sentence during the appeal, but later the us supreme court overturned the verdict in another appeal.
