Sam, a farmer, needs to install a piece of equipment in his barn. the equipment, which weighs 2,000 pounds, must be lifted thirty feet into a hayloft. sam goes to abc hardware owned by durham and tells durham that he needs some heavy-duty rope to be used on his farm. durham recommends a one-inch-think nylon rope, and same purchase two hundred feet of it. same ties the rope around the piece of equipment, put the rope through a pulley, and with the aid of a tractor lifts the equipment off the ground. suddenly, the rope breaks. the equipment crashes to the ground and is extensively damaged. sam files a suit against abc hardware for breach of the implied warranty of fitness for a particular purposed. discuss how successful (or not) sam will be with his suit.
