C. Precedent is an outdated concept in American law because the nature of crime and criminal defense is changing so quickly as a result of technology, so every criminal trial is now unique.
D. There is no relationship between stare decisis and precedent; stare decisis is specific to federal courts, and precedent applies only to municipal and state courts.
