Abigail Smith is a 40 year old flight attendant. She instructed a passenger that they must remain in their seat while the plain is landing. The passenger became aggravated and told Smith to leave her alone. The passenger began to open the overhead compartment and a big piece of luggage fell and hit Smith in the head. Smith became enraged and started cursing at the passenger over the intercom. Smith then grabbed her belongings and activated the evacuation slide and left the plane. Smith was later arrested and charged with criminal mischief and reckless endangerment. If found guilty, Smith can serve up to seven years in federal prison. Should she be detained or released?
