Giàu là đối tượng lười lao động, không có việc làm, thu nhập, nhưng thường xuyên tụ tập uống rượu và gây gổ, đánh nhau. Khoảng 17 giờ 30 phút ngày 27/6/2016, sau một chầu nhậu về, Giàu bắt đầu chửi ông Vui (bố đẻ của Giàu) với những lời lẽ hết sức hỗn láo: "Ngày trước tao còn nhỏ mày đánh tao, bây giờ tao đã lớn, thằng nào há miệng tao bóp cổ chết tươi". Đúng lúc đó, Nghèo (anh ruột của Giàu ) đi làm về nghe Giàu chửi ông Vui nên rất bực tức nên đã chỉ mặt Giàu răn đe: "Nếu còn hỗn láo với cha mẹ, có ngày tao đánh chết". Dù vậy, Giàu vẫn tiếp tục chửi ông Vui. Thấy Giàu hỗn láo quá mức, không coi lời nói của mình ra gì nên Nghèo chạy ngay vào bếp rút con dao lưỡi bầu mũi nhọn (kích thước 25 cm x7 cm) đâm liên tiếp 4 nhát dao vào bụng của Giàu khiến Giàu gục chết tại chỗ. Trường hợp nêu trên Nghèo phạm tội gì? Tại sao?
