Case 8 - Escobido v. Illinois, 378 U. S.478 (1964). Danny Escobedo's brother-in-law, Manuel, was shot and killed. The police arrested and interrogated Escobedo. Escobedo asked to speak to his attorney before he answered any questions. Even though his attorney was at police headquarters waiting to talk to him, the police did not allow him to. The police continued to question Escobedo without letting him talk to his lawyer, until he confessed to the shooting. His confession was used against him at his trial. He appealed to the U. S. Supreme Court, arguing that his confession was taken from him illegally. Discussion Questions:What part of the Fifth Amendment was involved?How would the Supreme Court go about deciding the case (what would it consider)?How do you think the Supreme Court should rule, and why?
