The Swindler case discussed at the beginning of the chapter involved a private company banning someone from visiting its properties. Transportation during medieval times involved governments banning convicted people from their homeland. Consider these banishment practices within a historical context.
1. Should judges in the United States today impose banishment as a sentence? Should people be banned from towns, counties, states and the United States? Explain your answer.
2. What are some of the possible unintended consequences that may result from the practice of banishment? Can you think of a situation where the act of banishment could cause a greater harm than the actual crime being punished?
3. Is the practice of banishment more effective if coupled with other forms of punishment, such as fines or community service? How might the type of punishment applied along with banishment differ by offense type? Would the seriousness of the offense matter?
