The case overturn the decision of the other cases of Supreme Court i.e. Brown versus Board of Education of Topeka in 1954.  

The decision was influenced by French, which taught toleration towards people of other colour. This case challenged Louisiana Separate Car Act. The decision legalised many laws made by the state. Plessy was an “Octoroon”.

Octoroon referred to a person of 7-8th whites and 1-8th black ancestry. Octoroon was from New Orleans, who violated the Separate Act. The lawyer of Plessy defended him by saying that the law was made unconstitutional. He lost the case and he appealed to the Supreme Court of USA. Supreme Court by 7-1 majority decided that the law of Louisiana did not violate the 14th amendment.  It established the fact that there is equality among White and Black Americans legally. It eliminated all social distinctions which were earlier based on colour. The state legislature of America made laws on health and safety. It too determined police powers. John Marshall said that the Constitution of USA is colour- blind.
