The police found marijuana and growing equipment when they searched a man's house. He was prosecuted criminally, but the federal government also sought civil forfeiture of his house, pursuant to a federal law. The man challenged this action, claiming that the proposed forfeiture of his house would amount to double jeopardy, a violation of the Fifth Amendment. Should civil asset forfeiture in addition to criminal prosecution be considered double jeopardy and thus be unconstitutional
